Terms & Conditions — Ignite Outdoor Kitchens

These Terms & Conditions (“Terms”) govern your access and use of the Site and Services offered by Ignite Outdoor Kitchens, LLC (“we,” “us,” “our”). By using the Site or requesting Services, you agree to these Terms.

1. Acceptance & Use

By accessing or using the Site or Services, you agree to be bound by these Terms and applicable laws. If you disagree with any part, do not use the Site or request Services.

2. Service Quotes, Proposals & Orders

·         All quotes and proposals are non-binding unless expressly accepted in writing or through a formal agreement.

·         Prices may change based on material costs, site conditions, scope adjustments, or logistics.

·         You are responsible for accuracy of information you submit (measurements, images, location).

·         We reserve the right to decline or cancel any order or quote at our sole discretion.

3. Payment & Fees

·         A deposit or down payment may be required before commencing work.

·         Remaining balance must be paid before or upon completion, as agreed.

·         Late payments may incur fees or interest per applicable law.

·         We accept methods as set forth in your proposal (credit card, ACH, financing, etc.).

4. Changes & Cancellations

·         If you request changes after work begins, additional fees and time may apply.

·         Cancellation before work begins may require forfeiture of deposit or a cancellation fee, as stated in the contract.

·         Once materials are ordered or delivered, cancellation may not be possible for that portion.

5. Site Access & Conditions

·         You grant us and subcontractors access to your property as needed.

·         You must ensure the site is safe, permits are obtained (if required), utilities accessible, and existing obstacles disclosed.

·         Delays due to site conditions, weather, or customer responsibilities are not our fault and may add charges or time.

6. Warranty, Liability & Disclaimers

·         We warrant workmanship per terms in your contract. Manufacturer warranties apply to materials.

·         To the maximum extent allowed by law, we exclude liability for indirect, incidental, or consequential damages.

·         Our aggregate liability will not exceed the amount you paid under that job.

·         We make no guarantees of specific results beyond what is explicitly agreed.

7. Intellectual Property & Use of Site

·         The content, materials, design, software, and trademarks on the Site are owned by us or licensed to us and are protected by law.

·         You may use the Site for your personal, non-commercial use only.

·         You may not copy, modify, distribute, or use the materials on the Site without prior written permission.

8. Links to Other Sites

The Site may contain links to third-party websites. These links are for convenience only; we do not control or endorse those sites and are not responsible for their content or practices.

9. Privacy & Data

Your privacy is important to us. Our Privacy Policy governs our collection and use of your personal data. By using the Site or Services, you agree to that policy.

We do not share your mobile number or opt-in data for marketing third parties. Data may be shared with subcontractors or service providers strictly for project support.

10. Modifications

We reserve the right to modify these Terms at any time. Revised Terms will be posted on the Site with an updated “Last Updated” date. Continued use after changes means you accept them.

11. Governing Law & Dispute Resolution

These Terms and any disputes will be governed under the laws of the State of Texas, regardless of conflict of law principles. You consent to the exclusive jurisdiction and venue of state or federal courts located in Travis County, Texas.

12. Severability & Waiver

If any provision is found invalid or unenforceable, that part may be severed, but the remaining Terms remain in effect. Failure to enforce any right is not a waiver.
